Please
read the following policy notification:
The following agreement is by and between
Webmastery.Org ("Webmastery.Org") and Client ("Client")
WHEREAS, Webmastery.Org is a Web Design, Hosting, and Internet
Promotion company.
WHEREAS, Client seeks to utilize Webmastery.Org
services
to develop
a web site for his/her own purposes;
WHEREAS, the parties
acknowledge
that the Internet is neither owned nor controlled by any
one entity;
WHEREFORE, Webmastery.Org can make no guarantee
that any given reader shall be able to access pages at any
given
time. Webmastery.Org represents that it shall make every
good faith effort to ensure that its servers are maintained
and
live;
NOW THEREFORE, in consideration of the mutual promises
contained herein, the parties agree to the terms and conditions
as follows;
Support
- Free customer support is provided via telephone and email.
Phone support is available between the normal business
hours
of 9:AM
and 5:PM Eastern Standard time.
Voice
mail
service
is available 24 hours
a day. Replies will be made via e-mail unless phone is
deemed more appropriate. Emailed requests will be the quickest
way to assure a timely response if your call is answered
by Webmastery's Voice mail service.
- Billing inquiries will be answered within 24 hours.
- Client agrees not to spam support.
Payment Policy
Hosting
Fee Monthly Fee
- All hosting services are on a monthly prepayment basis
unless client preferred alternate prepayment programs.
- Full payment is required before any hosting service is
rendered, which includes renewals.
- The monthly prepayment is non-refundable.
- Bills or invoices are not guaranteed to be sent by postal
mail or fax.
- Prepayment is due each month, anniversary (year) or half
(6 months) following the date the account was
established. (If the account was established at the end
of the month -
the anniversary dates may be subject to adjustments.)
- Payment Method - Checks/Money Orders
- Print Domain Name/Client Number on Check.
- Client has 15 days to get payment to Webmastery.Org after
receiving their invoice. After 15 days all accounts are
subject to a $25.00 late payment fee.
- Payment must be received or services are not rendered.
- If payment is not received within 30 days, the account
is subject to cancellation.
- If a check is returned due to non-sufficient funds, there
will be an additional processing fee of $25, plus the
$25.00 late fee.
Policy Changes
- Webmastery.Org reserves the right to change prices at
any time.
- All monetary transactions will occur in dollars.
Renewal Notification and Billing
Schedule
Renewal notification is faxed to the billing contact
thirty (30) days prior to the end of the billing cycle.
Checks or money orders are due within 15 days of the first
notification. If payment is not received, the account
is
cancelled at the end of the billing cycle.
Returned Checks:
Non-Sufficient Funds, If a check is returned, the client
is subject to a $25 processing fee plus the
$25.00 late fee if the account enters into a late payment status.
Account
Reactivation
If an account was cancelled due to
client request or billing issues and the client desires to
reactivate the account,
a non-refundable reactivation fee of $20.00
will be required prior to account reactivation. Accounts
are reactivated after
all outstanding charges are paid, including
hosting fees, design fees, and check processing fees.
If
an account was cancelled due to policy violation, Webmastery.Org
will not reactivate the account.
Refund
Policy
- For new accounts, the set up fee is non-refundable after
30 days.
- There is a 30 day full refund policy.
- If Server terminates an account due to policy violation,
there will be no refund. The policy violator
may be charged a $500 clean up fee.
Cancellation
- Webmastery.Org reserves the right
to terminate service at any time. If an account is terminated
for a policy violation
there will be no refund. Webmastery.Org
reserves the right to delete the policy violating web site
content without notice.
- Customers can cancel service at any time. All account
cancellations are to be requested through email.
- If the client requests cancellation, their account will
be terminated at the end of the current billing cycle,
or immediately.
If the client specifies immediate account termination,
- Webmastery.Org
reserves the right to delete the
web site contents without notice.
- If an account is cancelled due to non-payment,
Webmastery.Org reserves the right to
delete the web site contents without
notice.
Indemnification
Client agrees to defend, indemnify
and hold harmless Webmastery.Org against any liabilities
arising out of defective products
sold to customers from servers, personal
injury or property damage caused by products or services
sold or distributed
from servers, any material that infringes
or allegedly infringes on the rights of a third party available
from servers, and
any material that libels or allegedly
libels a third party available from servers.
Disclaimer
Webmastery.Org is not responsible for any damages to
any client's business. Webmastery.Org makes
no warranties or guarantees of
any kind, expressed or implied for
services that we provide. Use of Webmastery.Org web hosting
and
email service is
at the client's sole risk. Webmastery.Org
services are provided on an "as
is, as available" basis. Server does not guarantee
that our services will be uninterrupted or error
free.
Server will provide every effort in
good faith
to ensure that its services
are available to as many Internet users as possible
with minimal service interruptions.
In
no circumstance will Servers be liable for any claims
resulting
from the use
or inability to use Servers
services - including, but not limited to,
service interruptions, client
errors, Internet
connectivity problems, miscommunications,
unauthorized access to servers,
InterNIC problems, DNS caching,
Internet bandwidth congestion,
power failures, vandalism, and natural
disasters.
Webmastery.Org reserves the right to revise our policies
at any time.
